This privacy policy describes how Blushington LLC (“Blushington”, “we”, “us” or “our”) collects, uses, shares, and protects personal information. It also tells you about the rights and choices you have with respect to your personal information, and how you can reach us to get answers to your questions.
What We Collect
The following are examples of the types of personal information that we collect and how we use that information:

Sweepstakes, Contests, and Promotions |
When you participate in a sweepstakes, contest, or other similar campaign or promotion, we collect your name, contact information, and in some cases limited demographic information and content generated by participants. Some campaigns and promotions have a social networking component where you can choose to submit additional information such as social media profiles and handles, photographs, and other content. |

In addition to the personal information we collect from you directly, we may also obtain information about you from other sources, including third parties, business partners, our affiliates, or publicly available sources. For example, if you have given Blushington permission to store your credit card information and your credit card issuer provides an account updater service, we may receive updated credit card information (including credit card number and expiration date) from the credit card issuer.
Blushington may combine information collected from you with demographic and other information that is publicly available or that we obtain from third parties. Blushington may use this combined information for the purposes described above.
HOW WE USE YOUR PERSONAL INFORMATION
We use personal information in the following ways:
- To identify you when you visit our websites or stores.
- To fulfill your requests, such as to provide you with products and services or to process returns.
- To communicate with you about our products, services, sales, offers, and promotions.
- To conduct research and analytics, including improving our services and product offerings.

Although the sections above describe our primary purpose in collecting your personal information, in many situations we have more than one purpose. For example, if you complete an online purchase, we collect your information to perform our contract with you, but we also collect your information so that we can quickly and easily respond to any questions about your order after your transaction is complete.
HOW WE SHARE YOUR PERSONAL INFORMATION

- Social Media Platforms and Networks. Some of our websites have features such as, plugins, widgets, or and other tools made available by third parties that may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook. Their use of your information is not governed by this privacy policy.
- Legal Process. We may disclose personal information in response to subpoenas, warrants, court orders, government inquiries or investigations, or to comply with relevant laws and regulations. We may also disclose information to establish, exercise, or protect the rights of our company, employees, agents, and affiliates; to defend against a legal claim; to protect the safety and security of our visitors; to detect and protect against fraud; and to take action regarding possible illegal activities or violations of our policies.
- Other Instances. We may ask if you would like us to share your information with other third parties who are not described elsewhere in this privacy policy.
SECURITY
Your personal and contact information is stored on servers located in the United States. Though we and our service providers use multiple technologies and tools to protect your personal and contact information against unauthorized disclosure and use, no method of securing data is foolproof or completely effective, and third parties may unlawfully access or intercept data transmissions, communications or stored data, and may unlawfully use the data. Thus, although we take reasonable measures to protect the private data that we hold, we cannot guarantee that your personal and contact information will remain private or secure.
THIRD PARTY WEBSITES
If you reach our site using a link or coming from another web site or search engine, or go to another site from our site, information about your visit to our site may be collected by the other website or search engine, and will be subject to the privacy policy of that site. You are encouraged to review the privacy policy of each of those sites or search engines.
CALIFORNIA RESIDENTS
California residents can choose to opt out of the “sale” of their personal information to third parties. California residents may click here to set their privacy preferences.
As of January 1, 2020, under California law, you have the right to request all the data a company has collected on you over the previous 12 months. Blushington complies with this law. If you wish to request your information, please submit a request to the address below under “Contact Us”.

We may revise this privacy policy from time to time. We will notify you of changes by posting the effective date of the latest version at the top of this privacy policy.
COOKIES/JAVASCRIPT AND PERSISTENT USER IDENTIFICATIONS
Blushington may use “cookies” and/or other persistent identification methods to enhance your experience with our site. Cookies are text files we place in your computer’s browser to store your preferences. Blushington may use cookies and/or other persistent identification methods to understand site usage and to improve the structure, content and offerings on our site. For example, Blushington may use cookies to personalize your experience at our web pages (e.g. to recognize you by name/username when you return to our site), save your password in password-protected areas, and enable you to use shopping carts on our site. Blushington also may use cookies and/or other persistent identification methods to offer you products, programs, or services. Transmission of Information to Other Countries
Blushington is located in the United States and our service providers may be located in the United States or other countries. CHILDREN’S PRIVACY
Blushington does not collect any personal information from anyone who we know to be under the age of thirteen (13). If you are under the age of thirteen (13), you may use this web site only with the involvement of a parent or guardian and should not submit any personal information to us.

PLEASE READ THESE TERMS OF USE (THE “TERMS”) CAREFULLY BEFORE USING THIS SITE.
Blushington LLC, its affiliates, and their agents, successors and assigns (collectively, “Blushington,” “we,” “us,” “our”) provides website features and other products and services (the “Services”) when you visit or shop through its website located at www.blushington.com, and all associated domain names and all other websites and domain names affiliated with Blushington, and any other linked pages, features, content, or application services offered from time to time by us in connection therewith (collectively, the “Site”).
These Terms apply to your use of the Site and the Services offered through it. Your use of the Site indicates your acceptance of the Terms, including the policies incorporated into them by reference. If you do not accept the Terms, you must not use the Site or the Services.
THESE TERMS INCLUDE AN AGREEMENT TO MANDATORY ARBITRATION, WHICH MEANS THAT YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO THIS SITE, THE USE OF OUR SERVICES, OR THESE TERMS TO BINDING ARBITRATION RATHER THAN PROCEEDING IN COURT. - PRIVACY AND SECURITY
Please review our general Privacy Policy and California Privacy Policy (together “Our Privacy Policy”) which our Terms incorporate. Our Privacy Policy applies to and governs your use of the Site. Accordingly, as a condition of using the Site, you agree not to use the Site or its contents or information for any commercial or non-personal purpose (direct or indirect) or for any purpose that is illegal, unlawful or prohibited by the Terms. SEO practices considered unethical, or “black hat” (aka “spamdexing”) include, though are not limited to cloaking, meta data and title tags, content scraping, link schemes, Google bombs, keyword stuffing, hidden text and links, doorway and cloaked pages, link farming or schemes, blog comment spam, etc.;
- use the Services in violation of any the Terms or in a manner that violates applicable law, including but not limited to anti-spam, export control, privacy, and anti-terrorism laws and regulations and laws requiring the consent of subjects of audio and video recordings, and you agree that you are solely responsible for compliance with all such laws and regulations;
- do anything else which could cause damage to the Site, Blushington, and its employees and reputations, or would otherwise have a negative impact; or

2.2 Member Account, Password and Security: You may need your own Blushington account to use certain Services, and you may be required to be logged in to the account and have a valid payment method associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18 years old, you may use the Services only with the approval of your parent or guardian. Blushington will not be liable for any loss or damage arising from your failure to comply with this Section.
2.3 Modifications to Service: Blushington reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that Blushington will not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.

3.1 User Conduct: You agree to not use the Services to:
- interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
- violate any applicable local, state, national or international law, or any regulations having the force of law;
- impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; solicit personal information from anyone under the age of 18;

3.2 Special Notice for International Use; Export Controls: Software (defined below) available in connection with the Services and the transmission of applicable data, if any, is subject to United States export controls. No Software may be downloaded from the Services or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk. - INTELLECTUAL PROPERTY RIGHTS
4.1 All content of this Site including, without limitation, all trademarks, service marks, tag lines/slogans, logos, names, text, copyrightable subject matter, images, graphics, designs, software, music, sound, video, audio-visual recordings, data and products belong exclusively to Blushington or its suppliers, vendors, service providers or its licensors (collectively, such third parties, Blushington’s “vendors”), and is protected by United States and international intellectual property laws. The selection, coordination, arrangement, and enhancement of all content on this Site, as well as any content original to Blushington, is owned exclusively by Blushington and is protected by United States and international copyright laws. All rights are reserved by Blushington.
You may not use any cookies, meta tags or other metadata, or other forms of hidden text or code that include Blushington’s intellectual property without the express prior written permission of Blushington and, without limiting the foregoing, you may not use of Blushington’s trademarks, service marks, tag lines/slogans, logos or names in any manner may cause confusion among consumers, nor in any manner without the express prior written consent of Blushington. All trademarks that appear on this Site that are not owned by Blushington are the property of their respective owners. You may not use any trademarks, copyrights or other intellectual property owned by Blushington in any negative or malicious way or to advertise products or services we do not sell.
You acknowledge and agree that the Services may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. The technology and software underlying the Services or distributed in connection therewith are the property of Blushington, our affiliates and our partners (the “Software”). Any rights not expressly granted herein are reserved by Blushington.
- VENDOR SOFTWARE AND SYSTEMS
In addition, certain elements of the Site are operated or use software from Blushington’s vendors pursuant to contractual agreements with Blushington. Such vendors are not affiliates and have no relationship other than through these commercial arrangements.
- COPYRIGHT COMPLAINTS/NOTICES OF COPYRIGHT INFRINGEMENT
If you believe your work or content has been copied and posted to the Site in a way that constitutes copyright infringement, please provide Blushington’s designated copyright agent the following written information in accordance with the Digital Millennium Copyright Act (the “DMCA”):

Under no circumstances will Blushington be liable in any way for any content or materials of any third parties (including users), including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. Blushington does not monitor, approve or have any control over any Third-Party Content or the third-party sites and the inclusion of links to Third Party Content or third party sites does not imply any association or relationship between Blushington and such third party. You click through at your own risk, and Blushington makes no representation or warranties about the content, completeness or accuracy of the sites hyper-linked to this Site, and all use of the hyper-linked site will be subject to the terms of use and privacy policies of that site.
- COLORS, PRODUCT DESCRIPTIONS AND CONTENT
Blushington displays colors of our products on our Site as accurately as we believe practical, but the actual color you see depends on the lighting and camera equipment used, the reproduction of the images, and the accuracy of the color reproduction on your screen. Blushington attempts to be accurate in the descriptions of the products and other content on this site, however we cannot warrant that the product descriptions or content are error-free, complete or accurate.
All of the information on this Site is current only as of the date it is posted, whether or not such date is indicated.
- RESERVATION OF RIGHTS
Blushington reserves the right, at any time, without notice and in its sole discretion, to terminate your license to use the Site and to block or prevent your future access to and use of the Site. Please be aware that if you access this Site via your mobile phone or provide a mobile phone number to us in order to be contacted by voice or text message, your carrier’s normal rates and fees, such as text messaging fees or data charges, will still apply. A force majeure event is any event beyond the Covered Parties’ control and can include, but is not limited to, natural disasters, weather conditions, fire, nuclear incident, electro-magnetic pulse, terrorist act, riots, war, arson attacks, insurgency, rebellion, armed hostilities of any kind, labor disputes, lockouts, strikes, shortages, government actions or restraints, pilferage, bankruptcy, machinery breakdown, network or system interruptions or breakdown, internet or communications breakdown, quarantine, epidemic, pandemic etc. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for other wrongdoing (including any liability in tort), as to any products and/or Services available through the Site. Blushington does not guarantee continuous access without interruption to the Site.
Blushington will bear the responsibility required by relevant laws only if it is at fault for engaging in intentional or willful misconduct or it is grossly negligent in providing the relevant service. To the extent permissible pursuant to the relevant applicable laws, and without prejudice to the limitations set out in the Terms, the liability of Blushington, in the aggregate, will not exceed the lesser of (a) the cost of any Services from Blushington for which you purchased in the last month; or (b) two hundred and fifty United States dollars (or its equivalent in local currency). In case of an overcharge or mischarge caused by Blushington, you can make a claim regarding all erroneous charges notwithstanding what is set out above.
In addition, limitation of or exemption from the aforementioned liability may not be permitted pursuant to the relevant applicable laws. In such case, Blushington shall bear the liability to the extent set forth in the relevant laws. Claims should be submitted as soon as possible after occurrence of the event giving rise to the claim. Claims submitted with undue delay may be considered void pursuant to applicable statute of limitations. Only bona fide claims will be considered.
- INDEMNIFICATION
You agree to defend, indemnify and hold harmless Blushington (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), from all claims, demands, losses, liabilities, costs, expenses, obligations and damages including reasonable legal fees, arising out of or relating to (a) your use of the Site; (b) your violation of any term of these Terms of Use; (c) a breach of your representations and warranties set forth above regarding this Site; (d) your violation of any law or the rights of a third party (including, without limitation, any copyright, property or privacy right); or (e) any claim that any content you submitted caused damage to a third party. Blushington is committed to customer satisfaction. We will try to resolve any concerns or problems with our services that you may have. If we are unsuccessful, any dispute or claim arising out of or relating to this Section and your relationship with Blushington or any subsidiary, parent or affiliate company or companies (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration, except that either of us may take claims to small claims court if they qualify for hearing by such a court.

For all disputes, whether pursued in arbitration or small claims court, you must first send a written description of your claim to us to allow us an opportunity to resolve the dispute. You and we each agree to negotiate your claim in good faith. You may request arbitration if your claim or dispute cannot be resolved within 60 days from our receipt of your written description of your claim. The arbitration of any dispute or claim will be conducted in accordance with the rules of the American Arbitration Association (“AAA”), including the AAA’s Consumer Arbitration Rules (as applicable), as modified by this Section. The AAA Rules and information about arbitration and fees are available online at www.adr.org. To the extent of any inconsistency, this Section will supersede and govern over the AAA Rules.
You and we agree that this Section evidences a transaction in interstate commerce and this arbitration provision will be interpreted and enforced in accordance with the U.S. Federal Arbitration Act and federal arbitration law, and not governed by state law. Any arbitration will be held in a reasonably convenient location in the state in which you reside or at another mutually agreed location. The arbitration will be conducted in the English language. Otherwise, we will each bear the fees and expense of our respective attorneys, experts, witnesses and preparation and presentation of evidence at the arbitration.
In addition to the above, you and we each agree that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, consolidated or representative action, except for actions for injunctive relief as described below. To the extent permitted by applicable law, any determination of the extent to which your claims qualify as seeking public injunctive relief will be heard and decided by the arbitrator. If for any reason a claim proceeds in court rather than through arbitration, you and we each waive any right to a jury trial.
- WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Blushington’s failure to assert any right or provision under the Terms shall not constitute a waiver of such right or provision.

If any part of these Terms is unlawful, void, or unenforceable, solely that part, to the minimum extent possible, will be deemed severable, and will not affect the validity or enforceability of any remaining provisions. Blushington does not install extensions, but we can offer Blowouts if you have extensions for an up-charge.

Gratuity is not included for in store services, but much appreciated. 20% gratuity will be charged on all at home appointments at the time of booking.

Should I have wet or dry hair for a dry style?
For a Dry Styling appointment you should arrive with dry hair. If your hair is damp you will be charged the blowout pricing. Please note, this service does not include a hair dryer. Hot tools will be used instead.

How to prepare: We recommend washing and moisturizing your face before your appointment. Please have a place to sit with some room for your artist to lay out their professional makeup kit.
What type of false lashes do you use?
Blushington uses Ardell faux individual or strip lashes to enhance a subtle or statement look, and DUO lash adhesive. Latex free variety available.

What kind of Makeup will my Makeup Artist use?
Each makeup artist's kit is curated to include an array of Skincare and Makeup products in order to create a variety of natural beauty looks. The artists carry an assortment of female founded, luxury brands that are considered industry standards. All products are sanitized per Blushington's standards.
What is your at home booking policy in New York City?
All services will be charged at the time of booking with a 20% gratuity added. If you need to cancel or reschedule, please do so 24 hours before your appointment or you will be charged in full. If you need to cancel because you are feeling ill, please let us know at by calling (646) 536-4645 or emailing info@blushington.com and we will waive the cancelation policy. We are offering At-Home appointments in the NYC and Tristate area. Appointments booked outside of Manhattan are subject to a $1/mile surcharge, there is no mileage surcharge for appointments booked in Manhattan.
The health of our customers and our team is our number one priority. Your Blushington Pro Artist will arrive with fully sanitized makeup and tools needed for your appointment. And if you prefer to use your own brushes or products, we are happy to accommodate. Our Artists will arrive wearing a mask.
Do you have portfolios or Instagrams for me to look at so I can choose my team?
We are happy to choose the team for you based on preferences and photo inspiration, however, we do not have portfolios or Instagrams to offer at this time.
Can I split the payments for my wedding appointments on multiple cards?
No, we are not able to split payment across multiple cards or accounts. Blushington will charge one card on file for all services, including charges for tax and tip, once the services are completed.
Does Blushington Offer Services for Photo Shoots?

Can Artists use my makeup and tools?
Yes! While Pro Artists will always come prepared with tools and products, if there are specific items you prefer they use, just ask. They will take the same sanitizing precautions with your tools as they do with their own.
Why are Blush on the Go appointments subject to availability?
Similar to other businesses, our post-quarantine hours are limited to ensure the safety of our Pro Artists and clients. Services are now offered from 9:00 am to 7:00 pm and we will revise hours as guided by overall conditions.

Trials are 90 minutes and we make every effort to have the same team for your wedding day that you have for your trial. Our bridal services include an in-depth consultation, lashes, Our bridal appointments are also 90 minutes compared to the standard 45. Booking a trial/wedding day appointment ensures that you are booked with a member of our bridal team.
